General conditions for participants of Swiss Private Tours operated by Valuesource GmbH, Zurich, Switzerland
Swiss Private Tour operated by Value Source (GmbH), registered with Zurich Chamber of Commerce, specialized in providing value added service for private tours, travel and transfer services in Zurich, Switzerland. The purchase of any of our services offered by Swiss Private Tour by Valuesource (GmbH), constitutes a contractual arrangement between you (the client) and Swiss Private Tour by valuesource (GmbH), Zurich, Switzerland and represents your acceptance of the Terms & Conditions. Please ensure that you read carefully and understand the Terms & Conditions prior to booking.
1. Tour Booking
Bookings can be made through online, internet, travel agency, by phone, or via e-mail or in person. The contract between the client and the tour operator is concluded with the unconditional reservation through one of the distribution channels above. Through the reservation, the client accepts these terms and conditions as binding.
Tour reservation and payment for all our half-day, full day or multi-day tours must be booked directly through our online reservation system or by contacting us via email, phone or chat. Tours can also be booked and paid directly with our partner travel agents, hotels and affiliated partner companies. Tours can be booked as a guest and registration is not mandatory. Registered customers are able to manage reservations, alter tours and cancel reservation or benefit from special offers via the My Account portal.
Reservations should be made as early as possible to guarantee desired tour date (at least 30 days in advance recommended). If the desired tour date is not available (marked gray during the checkout process), this generally would mean the day is fully booked; if your desired date is not allowing to make a reservation online, we recommend that you contact us earliest as possible to check if alternative arrangements or solutions is possible to provide a tour on your desired tour date.
Important: We will treat all incoming tour requests as first in first serve basis; if the tour is booked and reserved by another party on the same date (conflict of schedule), pending orders / request will not be processed any further and the original requestor will be immediately notified via email as soon as conflict in our system is identified.
2. Risk and Insurance
The participants are not insured by the organizer. The participants are obliged to provide their own health and accident insurance coverage for the planned activity (including sport coverage).
The responsibility of Swiss Private Tour as the tour operator or/and their suppliers is limited. The tour operator is responsible for providing the services outlined in it’s website/brochure/offer. All services are subject to the laws of the country in which they are provided and to the conditions specified by the relevant suppliers.
In the absence of negligence of Swiss Private Tour, Switzerland, the participant waives any claim against the operator for injury, damage, loss, delay, irregularity (consequential or otherwise) or for any other cause to person or property which may occur in connection with such tour services or through the act of default of any company or person rendering any of the services included in the arrangements of the tour or otherwise in connection therewith or of any hotel proprietor or employee. Swiss Private Tour and/or their suppliers can accept no responsibility for losses or accidental expenses due to delay or changes in schedules, defaults, or overbooking of activities of 3rd party partners, sickness, weather, strikes, war, quarantine or other causes. All such losses or expenses will have to be borne by the participant.
Baggage and small articles (coats, etc.) are at the owner’s risk throughout the tour. Any further liability of Swiss Private Tour is excluded, irrespective of whether it is based on contractual or other grounds. The liability for property damage and financial loss is, in all cases, restricted to double the price of the program per person. The right is retained to decline, accept or retain any person as a member of the tour or to cancel or alter the tour.
The participants’ contract in use by the companies when issued, shall constitute the sole contract between the companies and the purchaser.
3. Health and Safety
- The group must at all times abide by the directions of the Tour Guide or Tour Director
- The Guide/Company must be notified in advance of clients’ which are suffering from any medical condition or are taking medication which is likely to interfere with their mobility and/or ability to fully participate in the agreed tour program
- Clients whose fitness level or medical condition is not considered by the Company/Guide to be appropriate for certain activities may be asked to make alternative arrangements. In such cases compensation will not be offered by the Company
- Clients should be aware that weather conditions in Switzerland can be severe and hence must be properly equipped
- Swiss Private Tour reserves the right to terminate a tour if, in the reasonable opinion of the company the behavior of a client or client group is or is likely to be disruptive, dangerous or upsetting to other people or if such client or group have caused or are likely to cause damage to property. Swiss Private Tour will not pay any refund or costs incurred by a client in the event that a tour is terminated due to unacceptable behavior
4. Complaints Procedure
Whenever possible, clients (customers) should promptly bring a complaint to attention of the Guide/Company. Clients wishing to lodge a complaint after the trip or tour should write to the company within 28 day’s of the tour end providing full details. The Company will endeavor to resolve such complaint in an amicable manner as expeditiously as possible.
5. Valid Travel Documents
All visitors to Switzerland needs to satisfy and adhere to the Swiss immigration and border security requirements; it is a must to carry valid travel documents on a tour which will be crossing the country borders. 6. Applicable Law/Court of Jurisdiction
All legal relationships between the participant and Swiss Private Tour are subject to the Swiss law. Zurich, Switzerland has been agreed upon as the place of exclusive jurisdiction.
